KSM Terror trial in New York City

The White House is holding firm on their decision to hold the trial of Self-confessed 9/11 mastermind Khalid Sheikh Mohammed in New York City.  Press secretary Robert Gibbs stated again today that he hopes that KSM will meet his maker after being convicted on US soil.   US soil doesn't sound so bad, since it leaves open the option for holding the trial at Gitmo.  That would take KSM out of the US civil justice system and put him into the hands of the military.

  Gibbs, however, went on to say  "We are talking with the authorities in New York,  We understand their logistical concerns and their security concerns that are involved. We have been discussing that with them."   Letting us know that the Obama administration is set on holding a show trial in NYC. 

Why is it a show trial? Because the President, the Media, and now Gibbs have already convicted KSM. KSM is guilty, he said so himself. He is the self proclaimed mastermind of the 9/11 terror attacks. We however, do have a legal system that KSM and his attorneys will play to their advantage. The Zacarias Moussaoui trial showed us how the system works. It showed us that a terrorist that admits guilt to conspiracy to commit terrorism, conspiracy to blow up an airplane, and conspiracy to use a weapon of mass destruction can avoid the death penalty. Moussaoui plead guilty, KSM likely will proclaim his innocence.

What will happen if KSM pleads not guilty? The whole system will be opened up by lawyers. Was KSM read his Miranda rights, no. Was KSM given a speedy trial, no. Was KSM tortured? According to the president of the United States of America he was. So how can any of his taped confessions be admitted into trial? The only way that KSM will be convicted and meet his maker as Gibbs says is if he has a show trial. There is no way that our civil system of laws can convict him legally. That is why foreign terrorists should not be tried in America. We are at war and they are captured on the battlefield. We can not expect our military personal to keep a clean crime scene. We can not expect them to put themselves at risk while conducting an "arrest" under fire. They are not the police.

Why then is the Obama administration so set on hosting this trial in New York City? It isn't that the citizens of The United States want the trial to be held there. According to a November poll by Zogby nearly two thirds of Americans want KSM tried in a military court. The real reason that many speculate is that the Obama administration want the Bush administration, the CIA, the military, and the American justice system all put on trial. KSM's attorneys will theoretically have the ability to cross examine each and everyone of these agencies. KSM will also have a pulpit in front of the world media to spout his hatred of the western world, capitalism, the United States, Israel, the Bush administration, and the War on Terror. He will rally terrorists to fight our forces, and the media will print and announce his message to the world. He will disclose our interrogation techniques and they will be less effective in the future.

There is absolutely no benefit to holding this trial in a civil court. We will either be mocking our system by silencing KSM or by not granting him the rights that our system ensures to anyone who is tried under it. If we do decide to try him with full rights then he will walk out a free man. President Obama said that will not happen since already promised that he would be found guilty. That promise alone is grounds for a mistrial. During the trial our whole country will be beaten down on the world stage, and lives will be put at risk. This is too easy to fix. How about that military trial at Gitmo, the founders put the military branch of the justice system there for a reason.
